Entitlement to accrued vacation days in case of change of employment?
When you change your employment status, you need to distinguish between holiday pay and holiday leave.
Under many collective agreements, employees receive their current salary at the time of the holiday. If you have changed your level of employment, this may mean that your holiday pay is based on your current part-time salary, even though the days were earned with full holiday pay. Similarly, the reverse may be true for those who have gone from part-time to full-time.
The second part concerns the length of the leave. The Holiday Act is based on the principle that everyone should have the same amount of leave regardless of their level of employment. If you work less than 5 days a week and take leave in one go, a vacation quota must be established. For example, if you work 3 days per week, the vacation quota is about 1.67. For each day taken, 1.67 days are deducted. If you work 1 day per week, the quota is 5, etc.
